Terms and Conditions

BACKGROUND:

These Terms and Conditions, together with any and all other documents referred to herein, set out the terms of use under which User may use this website, seeit1st.co.uk (“the Site”). User will be required to read and accept these Terms and Conditions when signing up for an Account. If User does not agree to comply with and be bound by these Terms and Conditions, User must stop using the Site immediately.

  1. DEFINITIONS

    In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

    “Account” means an account required for a User to access certain areas of the Site, as detailed in Clause 4;
    “Ad” means a Property Ad owned by the Third Party Property Advertiser that is collected by Us as an aggregator.
    “Content” means any and all text, images, audio, video, scripts, code, software, databases and any other form of information capable of being stored on a computer that appears on, or forms part of, the Site;
    “Property Advertiser” means a party responsible for the Ads delivered by Us to the Users.
    “Site” seeit1st.co.uk, is owned and operated by Us.
    “Third Party Advertising” means advertising displayed on the Site in addition to Ads
    “User” means a user of the Site;
    “We/Us/Our” means SEEIT1ST LTD, a company registered in England under Company Number 11442127, whose registered address is 4 Levendale Road, London, United Kingdom, SE23 2TW.
  2. ACCESS AND COMMUNICATION
    1. Access to the Site is free of charge and provided “as is” and on an “as available” basis. We may alter, suspend or discontinue the Site (or any part of it) at any time and without notice. We will not be liable to User in any way if the Site (or any part of it) is unavailable at any time and for any period.
    2. By using the Site, User indicates that it accepts these terms of use and agrees to abide by them. If User does not agree to these terms of use, it must not use the Site.
    3. We may from time to time send notices by Whatsapp to the Users. Such notices may include Ads and/or relate to matters including, but not limited to, service changes, changes to these Terms and Conditions, and changes to User’s Account.
    4. We are not responsible for the content of any Ad including, but not limited to, any errors, inaccuracies, or omissions. User will be responsible for any loss or damage suffered by an Ad.
    5. We will not be liable for any delays or failures in receipt of any communication as delivery is subject to effective transmission from User’s mobile telephone network provider and/or mobile telephone device.
    6. User should be aware that it may be charged by the mobile telephone network provider and subject to limitations in respect of any form of operational communication by its mobile telephone network provider, and these are beyond our control.

    8. All personal information that We may use will be collected, processed, and held in accordance with the provisions of EU Regulation 2016/679 General Data Protection Regulation (“GDPR”) and User rights under the GDPR.

  3. ACCOUNTS
    1. The Site requires an Account that has been verified through sending a Whatsapp message in order to deliver to User the Ad.
    2. When creating an Account, the information User provides must be accurate and complete. If any of information changes at a later date, it is User’s responsibility to ensure that its information is kept up-to-date.
    3. If User wishes to close its Account, User may do so at any time. Closing account will result in the removal of User information and remove access to any areas of the Site requiring an Account for access.
  4. INTELLECTUAL PROPERTY RIGHTS AND THE SITE
    1. The trademarks, logos, and service marks (collectively the “Trademarks”) displayed on the Site are our registered and unregistered Trademarks or are licensed by the relevant third party to us. Our Trademarks may not be used in connection with any product or service that is not our own, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us.
    2. User may not copy, use or imitate any text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, interactive content and scripts on the Site without our prior written consent. Unless otherwise expressly set out in these terms of use, nothing contained on the Site should be deemed to grant, by implication or otherwise, any licence, or right in or to any such content, without our express written permission.
    3. User misuse of the intellectual property displayed on the Site, or any other content on the Site is strictly prohibited.
  5. SECURITY
    1. We exercise all reasonable skill and care to ensure that the Site is secure and free from viruses and other malware including, but not limited to, the scanning of all Content. However, User is responsible for protecting its hardware, software, data and other material from viruses, malware, and other internet security risks.
    2. User must not attempt to gain unauthorised access to any part of the Site, the server on which the Site is stored, or any other server, computer, or database connected to the Site.
    3. User must not attack the Site by means of a denial of service attack, a distributed denial of service attack, or by any other means.
    4. By breaching the provisions of Clauses 5.2 and 5.3, user may be committing a criminal offence under the Computer Misuse Act 1990. Any and all such breaches will be reported to the relevant law enforcement authorities and We will cooperate fully with those authorities by disclosing User identity to them. User’s right to use the Site will cease immediately in the event of such a breach.
  6. AMENDMENT
    1. We may alter these Terms and Conditions at any time. Any such changes will become binding on User upon User’s first use of the Site after the changes have been implemented.
    2. In the event of any conflict between the current version of these Terms and Conditions and any previous version(s), the provisions current and in effect shall prevail unless it is expressly stated otherwise.
  7. TERMINATION
    1. These terms of use shall exist for an indefinite period of time. However, User may terminate the agreement at any time by permanently closing its Account.
    2. Agreement is terminated by disabling User’s account to prevent it from accessing or using the Site if User breach any term of these terms of use.
    3. We are not obliged to give you any notice of termination in advance.
  8. OTHER TERMS
    1. We reserve the right to disclose data about Users to any legal authority where we are obliged to by law, regulation or governmental request. We will not be obliged to notify User of any such disclosure.
    2. Any dispute, controversy, proceedings or claim between User and Us relating to these Terms and Conditions, or the relationship between User and Us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England and Wales
